Madie Strople: No. even if you are separated for 50 years you are not legally divorced..If you don't know where the other spouse is file for a missing spouse report and i guess if the spouse is found and wants to get divorced of course you can file for a divorce and if not found after a certain amount of time i think you can file for a divorce anyway check it out with an attorney ...

You are still legally married even if you've been separated for a long amount of time.If you do not know where your spouse is after this time, you would file a missing spouse divorce. This involves placing a Notice of Publication in the local newspaper for 30 days. If the spouse doesn't respond, then a default divorce will be granted.
